Terms and Conditions
1. Introduction
1.1 These Terms and Conditions (“Agreement”) govern the provision of electrical installation and maintenance services (“Services”) by Power On Electrical Contractors Ltd, a company registered in England Company Number 14568435 (“the Company”) to the client (“the Client”).
1.2 By engaging the Company for Services, the Client agrees to be bound by these Terms and Conditions.
2. Definitions
2.1 “Services” refers to the electrical installation and maintenance services provided by the Company as described in the service agreement or quotation.
2.2 “Quotation” refers to the written estimate provided by the Company for the provision of the Services, outlining the scope, cost, and timeline.
2.3 “Contract” refers to the agreement between the Company and the Client formed when the Client accepts a Quotation or formally engages the Company.
2.4 “Writing” can refer to email, text message, WhatsApp or any other forms of typed communication except verbal
3. Services Provided
3.1 The Company agrees to provide the quoted electrical installation and maintenance services:
- Electrical system installation
- Maintenance and repairs
- Testing and inspections
- Fault diagnosis and troubleshooting
- Upgrades or replacements of electrical components
3.2 The Company will provide Services in accordance with all relevant UK standards, including the latest IET Wiring Regulations (BS 7671) and Health and Safety Executive (HSE) guidelines.
4. Client Responsibilities
4.1 The Client agrees to:
- Provide accurate information about the electrical systems, appliances, and areas requiring service.
- Ensure that all areas requiring work are safely accessible to the Company’s personnel.
- Obtain any necessary permissions or consents for electrical work, including planning permissions or building control approval from relevant authorities.
- Provide a safe working environment, free of hazards that could affect the safety of the Company’s operatives.
- Provide use of welfare facilities including toilet, clean water and waste bins
- Given the nature of the work to be carried out, some disruption to the property is likely. However, we aim to leave any area as we found it, this includes clearing up any mess and all care will be taken to avoid damage.
5. Pricing and Payment
5.1 The Client will pay the fees set out in the Quotation for the Services provided. Unless otherwise agreed, all payments are due within 30 days of receipt of the invoice.
5.2 Any additional work required outside the scope of the Quotation will be subject to a separate charge, which will be agreed upon in writing before commencement.
5.3 Payments can be made via BACS, credit card or cash. Cash is subject to an additional charge of 4% due to banking fees
5.4 Late payments will be subject to a 10% late payment fee for each week the payment is overdue. Should an invoice become overdue, interest shall accrue from the date when payment becomes due, daily until the date of payment at the current rate of 8% plus the Bank of England base rate. This will be provided on a new invoice if payments are overdue.
- Where the Client defaults in payment, the Client shall indemnify The Company against all costs and disbursements incurred by The Company in pursuing the debt including all legal costs and any Debt Collection Agency or Solicitor fee’s.
- Should the Client remain in default for two consecutive months, The Company will suspend the Service being provided, or terminate the Supply of goods and Services until payment has been received.
- If an account remains overdue after sixty days (two months) then an administration fee of £50.00 shall be levied which shall be added to the outstanding invoice if less than £1000.00 or £80.00 if more than £1000.00, and a new invoice created.
5.5 All installation works require 25% of the contract value, any products installed or supplied remain the property of Power On Electrical Contractors Ltd until they have been paid for in full. Until then we have the right to remove any materials owned by us if payment is not made.
5.6 Any deposit paid will be protected by a Deposit Insurance Scheme for a period of 30 days
6. Estimates and Quotations
6.1 All Quoted prices are valid for 30 days from the date of issue. The Company reserves the right to revise prices after this period. Please ask us to reconfirm our prices should you require more time to decide.
6.2 Any changes in the scope of the work or unforeseen issues may lead to additional costs. The Company will notify the Client before any additional charges are incurred.
7. Liability and Insurance
7.1 The Company will carry out the Services with reasonable skill and care in accordance with applicable UK standards and regulations.
7.2 The Company’s liability for any damage or loss caused by the provision of Services will be limited to the total amount paid for the Services. The Company will not be held responsible for any indirect, consequential, or incidental damages.
7.3 The Company holds public liability insurance up to £10,000,000, which covers any potential damage caused during the provision of Services.
7.4 The Company holds professional indemnity insurance up to £500,000.00, which covers any potential issues caused by our design of the installation or incorrect advice provide.
7.5 Upon the works being completed the Client shall inspect the works and notify The Company within 24 hours of any defects, shortage in quantity or failure to comply with the original quotation.
Failure to comply with this requirement may mean that The Company is not liable for any such defect whether it constitutes a loss or not to the Client.
The risk for the goods passes to the Client upon delivery to the specified premises.
This applies regardless of whether The Company retains ownership or not.
8. Health and Safety
8.1 The Company will comply with all applicable Health and Safety legislation, including the Health and Safety at Work Act 1974 and the Electricity at Work Regulations 1989, ensuring a safe environment for all parties during the provision of Services.
8.2 The Client must ensure that the premises are safe and free from any hazards that could affect the Company’s ability to perform the Services.
9. Termination
9.1 Either party may terminate the Contract by providing 30 days’ written notice if the other party is in breach of the terms of the Contract and fails to remedy such breach within a reasonable time.
9.2 The Client may cancel or reschedule Services by providing 30 days’ written notice. If the Client cancels within 30 days of the scheduled appointment, the Client may incur a cancellation fee of £200.
On this occurring, if payment has been made in advance, The Company shall repay the Client in full.
Should the goods have been delivered, or the service have commenced then The Company may charge reasonable costs in having to cancel the contract, including the costs of collection of the goods, any supplier restocking charges and for any expenditure made as a result of entering into the contract including contract administration which is a minimum of £100.00 .
If you have entered into a contract and then terminated early you will be invoiced for works already completed and charged 50% for any remaining visits either at the required hourly rate including materials or as proportion of the quotation.
10. Warranty and Guarantees
10.1 The Company warrants that the Services will be performed in accordance with industry standards.
10.2 Any new installations or equipment supplied by the Company will be covered by the manufacturer’s warranty. The Company will not be liable for any issues covered by such warranties.
10.3 The Company offers a 2-year warranty on workmanship from the date of completion. If defects in workmanship arise during this period, the Company will rectify the issue free of charge.
11. Confidentiality
11.1 Both parties agree to keep any confidential information, such as business data, client information, or pricing
11.2 We sometimes use videos/images/customer’s names to promote business on the internet and other mediums. If you prefer us not too, please let The Company know. If you have any questions regarding these terms, please do not hesitate to discuss it with us. We are required to take photos of the work and work area.
Your personal information is kept private and safe securely until a time it is no longer required as detailed in the Data Protection Act 1998.
We will not sell or pass on your personal information to others outside of the company unless you request it in writing.
12. Dispute Resolution
12.1 In the event of a dispute, the parties agree to first attempt to resolve the issue through the mediation services offered or by negotiation without mediation.
12.2 If the dispute cannot be resolved, the parties agree that the dispute will be subject to the jurisdiction of the courts of Chichester or Portsmouth, UK.
13. Governing Law
13.1 This Agreement is governed by and construed in accordance with the laws of England and Wales.
14. Force Majeure
14.1 The Company will not be liable for any failure to perform the Services due to circumstances beyond its control, including but not limited to acts of God, strikes, or other unforeseen events.
14.2 Some situations relating to electrical work and installations we may come across problems and issues that could not be anticipated at the time of quotation and until the work commenced. Not all problems have an impact on the amount of work and cost anticipated and quoted for. However, should a situation arise where this is the case, we will advise you immediately, provide you with a solution(s) and advise you of the impact (if any) on prices quoted. We will only proceed with your agreement.
14.3 If our Operatives cannot attend, we will inform you as soon as possible to rearrange however, there may be a delay as an employee may be sick or materials not available due to supply shortages. The Company is not liable for any impact to you or progress of other trades whether it constitutes a loss or not to the Client.
15. Amendments
15.1 These Terms and Conditions may be amended at any time by the Company. The Client will be notified of any material changes, and the revised terms will apply to any work or Services provided thereafter.
